Chapter I General Provisions

Article 1 In order to strengthen the supervision and management of construction project supervisors and ensure the quality of construction project supervision, according to the China

Article 2 Supervision activities in the construction stage of construction projects within the territory of People's Republic of China (PRC) must abide by these Provisions.

The term "engineering supervision institution" as mentioned in these Provisions refers to the institution in which the supervision unit is stationed at the project site to be responsible for performing the entrusted supervision contract for construction projects (hereinafter referred to as the supervision contract).

The term "chief supervision engineer" as mentioned in these Provisions refers to the supervisory personnel with corresponding qualifications and authorized in writing by the legal representative of the supervision unit, who are fully responsible for the performance of the supervision contract and preside over the work of the project supervision institution.

The term "professional supervision engineer" as mentioned in these Provisions refers to the qualified supervision personnel who are responsible for the supervision of a certain profession or a certain aspect under the authorization of the chief supervision engineer.

The term "supervisors" as mentioned in these Provisions refers to supervisors who have corresponding qualifications and are authorized by the chief supervision engineer to engage in specific supervision work under the guidance of professional supervision engineers.

Article 3 The construction unit shall authorize the supervision unit to comprehensively control and manage the quality, cost and progress of the construction project, and make it clear in the supervision contract and the construction contract.

The construction unit shall support the supervisors to perform their duties.

The construction unit shall accept the supervision and management of the supervisors.

Article 4 No unit or individual may hinder or obstruct the construction project supervision activities carried out according to law.

Fifth people's governments at or above the county level construction administrative departments responsible for the supervision and management of supervisors.

Chapter II Project Supervision Institutions

Article 6 A supervision unit shall set up a project supervision institution at the project site. Organizational form and scale of project supervision organization

Seventh project supervision institutions are generally composed of chief supervision engineer, professional supervision engineer and supervision personnel, and may appoint the representative of the chief supervision engineer when necessary. The representative of the chief supervision engineer must be approved by the legal representative of the supervision unit and authorized by the chief supervision engineer in writing.

Project supervision institutions shall ensure that the professional support and quantity of supervisors meet the needs of supervision work.

Eighth project supervision institutions must abide by the relevant laws, regulations and technical standards of the state; Fully perform the supervision contract,

Control the quality, cost and progress of construction projects, manage relevant contracts of construction projects, and coordinate the relationship between relevant parties of construction projects; Do a good job in the management of all kinds of supervision materials, and submit a complete supervision file to the supervision unit or relevant departments after the supervision work.

Ninth project supervision institutions should control the quality of the project through patrol, inspection, witness sampling, parallel inspection and other means, and carry out on-site supervision of key parts or key processes.

The proportion of parallel inspection shall not be less than 5% of the inspection quantity of the construction unit, and the inspection expenses shall be borne by the construction unit.

Tenth project supervision institutions should be equipped with testing equipment and tools to meet the needs of on-site supervision according to the supervision contract.

The construction unit shall provide necessary office, transportation, communication and living facilities for the project supervision institution to carry out supervision work.

Eleventh supervision units should assess the work of project supervision institutions and guide the project supervision institutions to effectively carry out supervision work.

After completing the supervision work agreed in the supervision contract, the project supervision institution shall leave the site.

Chapter III Chief Supervision Engineer

Twelfth construction project supervision to implement the general supervision engineer responsibility system.

The legal representative of the supervision unit shall authorize the chief supervision engineer in writing, clarify his responsibilities and authority, and deliver the written authorization to the construction unit.

Thirteenth chief supervision engineer must meet one of the following conditions before taking up his post:

(a) to obtain the qualification of supervision engineer and register it, and have more than three years of relevant engineering supervision work experience;

(2) Having a college degree or above in related major, having been engaged in construction management of related projects for more than 20 years, having received training in supervision business, and having been approved by the provincial construction administrative department.

Fourteenth chief supervision engineer shall perform the following main duties:

(a) the organization of project supervision institutions, determine the responsibilities of personnel, fully responsible for the daily work of the project supervision institutions;

(two) presided over the preparation of supervision planning, examination and approval of supervision implementation rules and supervision work plan;

(three) the issuance of the application form for the commencement or resumption of the project, the order for the suspension of the project, the payment certificate for the project and the inspection form for the completion of the project. ;

(four) review the construction organization design, technical scheme and schedule submitted by the construction unit;

(five) review and sign the application, payment certificate and completion settlement of the construction unit;

(six) to review and deal with engineering changes;

(seven) to mediate the contract disputes between the construction unit and the construction unit, handle the claims and approve the project extension;

(eight) review the qualification of construction subcontractors;

(nine) presided over the supervision work conference, issued by the project supervision agency documents and instructions;

(ten) to preside over or participate in the investigation of engineering quality accidents;

(eleven) to organize the preparation and release of supervision monthly report, supervision work stage report, special report, project quality evaluation report and supervision work summary;

(twelve) review and sign the division and unit engineering quality inspection data, review the application for completion, organize the pre-acceptance of completion and participate in the completion acceptance;

(thirteen) presided over the project supervision information;

(fourteen) found that major engineering quality and safety problems, should cooperate with the relevant parties to take corresponding measures to deal with, and in accordance with the relevant provisions of the timely report to the construction unit and the construction administrative department.

Fifteenth chief supervision engineer has the following powers:

(a) when the project has the conditions to start or resume work, after obtaining the consent of the construction unit, issue a commencement order or a resumption order;

(two) found in the construction process of engineering quality problems or unsafe operations and other illegal situations, ordered the construction unit to rectify, until the project shutdown order;

(3) Examining the qualifications of construction units and subcontractors;

(four) review the construction organization design, technical scheme and schedule of the construction unit;

(five) review and confirm the project payment and project settlement;

(six) it is suggested to replace the unqualified project leader or unqualified construction subcontractor of the construction unit.

Article 16 During the performance of the supervision contract, the supervision unit shall not change the chief supervision engineer at will. If it is really necessary to change, it shall obtain the consent of the construction unit.

Seventeenth chief supervision engineer in principle can only undertake a supervision contract business, it is really necessary to undertake a number of supervision contracts at the same time, not more than three first-class engineering supervision contract business.

Eighteenth with the consent of the legal representative of the supervision unit, the chief supervision engineer may authorize the representative of the chief supervision engineer to exercise some of his duties and powers in writing.

The qualification of the representative of the chief supervision engineer shall not be lower than that of the professional supervision engineer.

The chief supervision engineer or the chief supervision engineer's representative must be resident at the site.

Chapter IV Professional Supervision Engineer

Nineteenth professional supervision engineer's responsibilities and authority should be stipulated in the written authorization of the chief supervision engineer.

Twentieth professional supervision engineers must meet one of the following conditions before taking up their posts:

(a) to obtain the qualification of supervision engineer and register it, and have more than two years of relevant engineering supervision work experience;

(two) with a college degree or above in related major, more than ten years of relevant engineering construction management experience, after supervision business training and approved by the provincial construction administrative department.

Twenty-first professional supervision engineer shall perform the following main duties:

(a) Under the guidance of the chief supervision engineer, patrol and inspect the construction site;

(two) responsible for the preparation of the corresponding professional supervision implementation details;

(three) to organize, guide, inspect and supervise the work of supervisors in this profession;

(four) review the construction organization design, scheme and application submitted by the construction unit, and submit the review report to the chief supervision engineer;

(five) to be responsible for the inspection and acceptance of sub-projects and concealed works of this major;

(six) regularly report to the chief supervision engineer on the implementation of supervision work;

(seven) do a good job of supervision diary;

(eight) responsible for collecting, summarizing and sorting out the corresponding regulatory information, and participating in the preparation of monthly regulatory reports;

(nine) according to the relevant provisions of the parallel inspection;

(ten) responsible for the professional engineering survey, audit engineering survey data and original documents.

(eleven) to arrange on-site supervision of key parts or key processes, and to inspect and supervise the on-site supervision work.

(twelve) found that the construction quality and safety problems, must take corresponding measures to deal with, and timely report to the chief supervision engineer.

Twenty-second professional supervision engineers have the following powers:

(a) require the contractor to submit the construction technology of key parts or key working procedures and measures to ensure the quality of the project;

(two) it is forbidden to enter the site without acceptance or unqualified acceptance of engineering materials, building components and equipment;

(3) refusing to sign on the parts or processes that have not been accepted or failed to pass the acceptance;

(four) require the construction unit to rectify the quality defects in the construction process.

(five) the project without acceptance or unqualified acceptance shall not be measured.

Chapter V Supervisors

Article 23 The written authorization of the chief supervision engineer shall specify the responsibilities and authority of supervision.

Article 24 A supervisor must meet one of the following conditions before taking up his post:

(a) with a technical secondary school degree or above in related majors, engaged in related professional work for more than one year, trained in supervision business, and approved by the provincial construction administrative department;

(two) with the relevant professional technician title, more than ten years of relevant professional work experience, after supervision business training and approved by the provincial construction administrative department.

Article 25 A supervisor shall perform the following main duties:

(a) to carry out specific supervision work such as quality supervision, testing and measurement under the guidance of professional supervision engineers;

(2) Check and record the original vouchers, test reports and other quality certificates of materials, equipment and components entering the site, as well as the usage of construction personnel;

(three) signed the original documents of engineering quality inspection and engineering measurement;

(four) responsible for the supervision in the station, and make a good record of the supervision in the station;

(5) Collecting and sorting out relevant regulatory materials;

(6) Keep supervision diary and relevant supervision records;

(seven) found major engineering quality and safety problems, timely report to the chief supervision engineer.

Twenty-sixth found that the construction activities endanger the quality and safety of the project, the supervision personnel have the right to stop and report to the chief supervision engineer in time.

Chapter VI Supervision and Administration

Article 27 The construction administrative department of the provincial people's government shall supervise and manage the work quality of supervisors, strictly examine the qualifications of all kinds of supervisors, establish the tracking management files of supervisors, and record the results of irregular inspections as an important basis for the annual inspection of supervisors and supervision units.

Twenty-eighth provincial people's government construction administrative departments should strengthen the continuing education of supervisors, and constantly improve the professional level of supervisors.

Twenty-ninth construction administrative departments shall instruct the relevant parties to deal with the quality and safety problems found by supervisors in the process of supervision; The behavior of the construction unit or the construction unit that hinders the supervision personnel from carrying out the supervision work normally shall be stopped and corrected in time.

Thirtieth construction units have the right to require supervision units to replace unqualified supervisors.

Chapter VII Punishment

Thirty-first construction units in violation of these provisions, one of the following acts, shall be ordered to make corrections, and may be fined; take its toll

, shall be liable for compensation according to law:

(a) the supervision unit expressly or implicitly agrees to the use of unqualified building materials, building components and equipment by the construction unit;

(two) without the signature of the chief supervision engineer, the project funds are allocated or the completion acceptance is carried out;

(three) hinder and obstruct the supervision personnel to carry out supervision work normally.

Thirty-second supervision units in violation of these provisions, one of the following acts, shall be ordered to make corrections, and may be fined; Cause great harm

In case of engineering quality accident, the qualification grade of the supervision unit shall be lowered until the qualification grade certificate is revoked; If losses are caused, they shall be jointly and severally liable for compensation according to law:

(a) engineering quality and safety accidents caused by supervisors' failure to perform their duties;

(two) collusion with the construction unit or the construction unit, resort to deceit, reduce the quality of the project;

(three) unqualified construction projects, building materials, building components and equipment in accordance with the qualified signature;

(four) to send unqualified personnel to undertake supervision work.

Article 33 A supervisor who violates these Provisions and commits any of the acts in Items (1), (2) and (3) of Article 32 of these Provisions shall be ordered to make corrections and may be fined; If a major engineering quality accident is caused, the registration certificate of the supervision engineer shall be revoked, and it shall not be registered within five years.

Registration; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-fourth construction units in violation of these provisions, one of the following acts, shall be ordered to make corrections, and may be fined; take its toll

, shall be liable for compensation according to law:

(a) collusion with the supervision unit, fraud, reduce the quality of the project;

(two) hinder and obstruct the supervision personnel to carry out supervision work normally.

Thirty-fifth construction administrative departments and their staff in violation of these provisions, one of the following acts, shall be ordered by the higher authorities to make corrections; If the circumstances are serious, the responsible person shall be given administrative sanctions; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Failing to supervise and manage the work of supervisors;

(two) abuse of power for personal gain, favoritism, accreditation does not meet the requirements of personnel to undertake supervision business.

Thirty-sixth the provisions of the fines, laws and regulations have provisions, from its provisions, there is no range of provisions for more than five thousand yuan to thirty thousand yuan.

Chapter VIII Supplementary Provisions

Thirty-seventh supervision or equipment supervision activities in other stages of construction projects shall be implemented with reference to these provisions.

Article 38 The construction administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may formulate detailed implementation rules in accordance with these Provisions.

Thirty-ninth these Provisions shall be interpreted by the administrative department of construction in the State Council.

Fortieth these Provisions shall come into force as of the date of promulgation. Before the implementation of these Provisions, if the relevant documents are inconsistent with these Provisions, these Provisions shall prevail.
