1. Men and women can sue for division of property after divorce. During the period of divorce, one party hides, transfers, sells, damages the joint property of husband and wife, or forges debts in an attempt to occupy the property of the other party. After the divorce, if the other party finds the above-mentioned behavior, it may bring a lawsuit to the people's court and request to divide the joint property of husband and wife again.
2. Legal basis: Article 1066 of the Civil Code of People's Republic of China (PRC).
During the marriage relationship, under any of the following circumstances, one of the spouses may request the people's court to divide the common property:
(1) One party conceals, transfers, sells, damages or squanders the joint property of husband and wife or forges the joint debt of husband and wife, which seriously damages the interests of the joint property of husband and wife;
(two) one party has a legal obligation to support the person who needs medical treatment because of a serious illness, and the other party does not agree to pay the relevant medical expenses.
Second, how to divide the divorce property
Divorce property is divided as follows:
1. General principle of equal share: When dividing the common property, both parties have equal rights and share the common property equally.
2. Adhere to the principle of taking care of the interests of children and women.
3. The principle of caring for the innocent party: the innocent party has the right to claim damages. But if you are wrong, it doesn't mean that you will "go out innocently".
4. The principle of fairness: the economic interests of both husband and wife should be liquidated at the time of divorce.
5. Respect the wishes of the parties, and the principle that the property agreement precedes the law: if the two parties reach mediation during divorce, they can agree on how to divide the property by themselves.
