What's the difference between a prosecutor and a judge?

The Law of the People's Republic of China on Public Prosecutors was adopted at the 12th meeting of the Eighth NPC Standing Committee in People's Republic of China (PRC) on February 28th, 2005, and is hereby promulgated and shall come into force as of July 28th, 2005.

Chapter II Responsibility

Article 6 Duties of public prosecutors:

(a) to carry out legal supervision according to law;

(2) To bring a public prosecution on behalf of the state;

(3) Investigating criminal cases directly accepted by people's procuratorates according to law;

(4) Other duties as prescribed by law.

The job content of a judge

1, review whether the prosecution decision is filed according to law;

2, to guide the work of the people's mediation committee according to law;

3. Ruling to take pre-litigation preservation or pre-execution measures according to law;

4. Solve the jurisdiction disputes between lower courts according to law and guide the work of lower courts;

5. Handling civil disputes and minor criminal cases that do not need to be heard in court according to law;

6. Participate in the collegiate bench trial or sole trial of the case according to law, find out the facts of the case through the trial of the case, apply the law and make a ruling;

7. Put forward judicial suggestions to relevant units according to law;

8. Ruling commutation and parole according to law;

9. Decide to take compulsory measures against those who obstruct litigation according to law.
