What is the nature of orchard land?

Orchard belongs to agricultural land and is not allowed to be used as construction land, but it does not include temporary facilities (nursing houses).

According to the Land Management Law and the land classification promulgated by the Ministry of Land and Resources, cultivated land refers to the land where crops are planted, including cultivated land, newly developed reclaimed land, leisure land, rest land and grass-field rotation land; Land where crops are mainly planted and fruit trees, mulberry trees or other trees are planted sporadically; On average, one season of aquaculture beaches and beaches can be harvested every year. Cultivated land also includes ditches, canals, roads and ridges with a width less than one meter in the south and two meters in the north.

Cultivated land can be divided into five types:

(1) Irrigated land refers to the cultivated land with guaranteed water source and irrigation facilities, which can be irrigated normally in general years and used for planting aquatic crops, including irrigated land and paddy-upland rotation land;

(2) Wang Tiantian refers to the cultivated land without irrigation facilities, mainly relying on natural rainfall, which is used to grow aquatic crops, including paddy-upland rotation land without irrigation facilities;

(3) Irrigated land refers to cultivated land that can be irrigated normally in general years except paddy fields and vegetable fields, and has water source guarantee and irrigation facilities;

(4) Dry land refers to the cultivated land without irrigation facilities and relying on natural precipitation to grow dry crops, including the cultivated land without irrigation facilities and relying only on flood diversion and sedimentation;

⑤ Vegetable field refers to the cultivated land that mainly grows vegetables all the year round, including greenhouse land.

Article 4 of the Land Management Law: The state practices a land use control system.

The state formulates the overall land use planning, defines the land use, and divides the land into agricultural land, construction land and unused land. Strictly restrict the conversion of agricultural land into construction land, control the total amount of construction land, and implement special protection for cultivated land.

The agricultural land mentioned in the preceding paragraph refers to the land directly used for agricultural production, including cultivated land, woodland, grassland, farmland water conservancy land and aquaculture water surface. Construction land refers to the land for building buildings and structures, including urban and rural housing and public facilities, industrial and mining land, transportation and water conservancy facilities, tourism land and military facilities; Unused land refers to land other than agricultural land and construction land.
