People's Republic of China (PRC) national defense law

Chapter I General Provisions Article 1 This Law is formulated in accordance with the Constitution for the purpose of building and consolidating national defense and ensuring the smooth progress of socialist modernization. Article 2 This Law is applicable to the military activities carried out by the state to guard against and resist aggression, stop armed subversion, and safeguard the sovereignty, unity, territorial integrity and security of the country, as well as military-related political, economic, diplomatic, scientific, technological and educational activities. Article 3 National defense is the security guarantee for the survival and development of the country.

The state strengthens the armed forces and the construction of frontier defense, coastal defense and air defense, develops national defense scientific research and production, popularizes national defense education for the whole people, improves the mobilization system and realizes national defense modernization. Article 4 The state independently builds and consolidates national defense, implements an active defense strategy and adheres to the principle of national self-defense.

While concentrating on economic construction, the state strengthens national defense construction and promotes the coordinated development of national defense construction and economic construction. Article 5 The State exercises unified leadership over national defense activities. Article 6 It is the sacred duty of every citizen of People's Republic of China (PRC) to defend the motherland and resist aggression.

People's Republic of China (PRC) citizens should fulfill their national defense obligations according to law. Article 7 The state and society respect and give preferential treatment to servicemen, protect their legitimate rights and interests, and carry out various forms of activities to support the army and give preferential treatment to its subordinates.

The China People's Liberation Army and the Chinese People's Armed Police Force carried out activities to support the government and love the people, and strengthened the unity between the military, the government and the people. Article 8 In its foreign military relations, People's Republic of China (PRC) maintains world peace and opposes acts of aggression and expansion. Article 9 The state and society shall commend and reward organizations and individuals who have made contributions to national defense activities in various forms.

In violation of this law and other relevant laws, those who refuse to perform national defense obligations or endanger national defense interests shall be investigated for legal responsibility according to law. Chapter II National Defense Functions and Powers Article 10 The National People's Congress decides on issues of war and peace in accordance with the provisions of the Constitution and exercises other functions and powers in national defense as stipulated in the Constitution.

According to the Constitution, the NPC Standing Committee decides to declare a state of war, decide on national general mobilization or partial mobilization, and exercise other functions and powers in national defense as stipulated in the Constitution. Article 11 In accordance with the decisions of the National People's Congress and the NPC Standing Committee, President People's Republic of China (PRC) declared a state of war, issued a mobilization order, and exercised other functions and powers in national defense as stipulated in the Constitution. Twelfth the State Council leadership and management of national defense construction, exercise the following functions and powers:

(a) the preparation of national defense construction and development plans and plans;

(2) Formulating principles, policies and administrative regulations for national defense construction;

(3) to lead and manage national defense scientific research and production;

(four) the management of national defense funds and national defense assets;

(five) to lead and manage the mobilization of national economy and people's armed forces, civil air defense, national defense transportation and other related work;

(six) to lead and manage the resettlement of yongjunyoushu and retired soldiers;

(seven) to lead the work of national defense education;

(8) Co-leading the construction, recruitment and reserve work of the Chinese People's Armed Police Force and militia with the Central Military Commission (CMC), and managing the frontier defense, coastal defense and air defense work;

(nine) other functions and powers related to national defense as prescribed by law. Thirteenth the Central Military Commission (CMC) leads the national armed forces and exercises the following functions and powers:

(a) Unified command of the national armed forces;

(2) To decide on the military strategy and operational policy of the armed forces;

(three) to lead and manage the construction of the China People's Liberation Army, formulate plans, plans and organize their implementation;

(four) to submit a motion to the National People's Congress or the NPC Standing Committee;

(5) To formulate military regulations and issue decisions and orders in accordance with the Constitution and laws;

(6) Deciding on the structure and establishment of the China People's Liberation Army, and defining the tasks and responsibilities of the headquarters, military regions, arms and services and other units at the military region level;

(seven) in accordance with the provisions of laws and military regulations, the appointment and removal, training, assessment and reward and punishment of members of the armed forces;

(eight) to approve the military weapons and equipment system and weapons and equipment development plan, and to cooperate with the State Council in leading and managing national defense research and production;

(nine) to manage national defense funds and national defense assets in conjunction with the State Council;

(ten) other functions and powers as prescribed by law. Fourteenth the State Council and the Central Military Commission (CMC) can hold coordination meetings according to the situation to solve the relevant problems in national defense affairs. Matters agreed at the meeting shall be organized and implemented by the State Council and the Central Military Commission (CMC) within their respective terms of reference. Article 15 Local people's congresses at various levels and the standing committees of local people's congresses at or above the county level shall, within their respective administrative areas, ensure the observance and implementation of national defense laws and regulations.

Local people's governments at various levels shall, within the limits of authority prescribed by law, administer conscription, militia, reserve, national defense education, national economic mobilization, civil air defense, national defense transportation, protection of national defense facilities, resettlement of ex-soldiers and pensions. Article 16 Local people's governments at various levels and resident military organs shall, as necessary, convene a joint meeting between the military and the people to coordinate and solve national defense affairs within their respective administrative areas.

The joint military-civilian meeting shall be jointly convened by the heads of local people's governments and resident military organs. Participants in the joint military-civilian meeting shall be determined by the convener.

Matters agreed upon at the joint meeting of the military and local governments shall be handled by local people's governments and local military organs according to their respective authorities, and major matters shall be reported to their superiors respectively.
