Article 1: In order to implement the classified management of environmental impact assessment of construction projects, this directory is formulated in accordance with the provisions of Article 16 of the Environmental Impact Assessment Law. Article 2 The state implements classified management of the environmental impact assessment of construction projects based on the degree of their impact on the environment.
Construction units shall organize the preparation of environmental impact reports, environmental impact report forms or fill in environmental impact registration forms in accordance with the provisions of this directory. Article 3 The term "environmentally sensitive areas" as mentioned in this directory refers to various types of natural and cultural protected areas at all levels established in accordance with the law, as well as areas that are particularly sensitive to certain types of pollution factors or ecological impact factors from construction projects, mainly including:
(1) Nature reserves, scenic spots, world cultural and natural heritage sites, and drinking water source protection areas;
(2) Basic farmland protection areas, basic grasslands, forest parks, and geological parks , important wetlands, natural forests, natural concentrated distribution areas of rare and endangered wild animals and plants, natural spawning grounds, feeding grounds, wintering grounds and migration channels for important aquatic organisms, natural fishing grounds, resource water-scarce areas, key soil and water loss prevention and control areas , desertified land closed reserves, closed and semi-closed sea areas, and eutrophic waters;
(3) Areas with the main functions of residence, medical and health care, culture and education, scientific research, administrative offices, etc., cultural relic protection Units, protected areas with special historical, cultural, scientific and national significance. Article 4 The sensitive nature and degree of sensitivity of the environment in which a construction project is located is an important basis for determining the environmental impact assessment category of a construction project.
Construction projects involving environmentally sensitive areas shall strictly determine their environmental impact assessment categories in accordance with this directory, and shall not increase or decrease the environmental impact assessment categories without authorization. The environmental impact assessment document should focus on analyzing the impact of the project on environmentally sensitive areas. Article 5 For cross-industry and composite construction projects, the environmental impact assessment category shall be determined based on the highest individual level among them. Article 6 For construction projects not specified in this directory, the environmental impact assessment category shall be proposed by the provincial environmental protection administrative department based on the characteristics of the pollution factors and ecological impact factors of the construction project and the sensitive nature and degree of the environment in which it is located. Report to the environmental protection administrative department of the State Council for recognition. Article 7 This list shall be interpreted by the environmental protection administrative department of the State Council, and shall be revised and published in a timely manner. Article 8 This directory will come into effect on June 1, 2015. The "Category Management List of Environmental Impact Assessment of Construction Projects" (Ministry of Environmental Protection Order No. 2) is abolished at the same time.
