On January 24th, 222, the Research Center of Household Administration of the Ministry of Public Security released the National Report on Newborns' Names in 221, and counted the most common names and characters in China and other places. Among them, the top 1 boys' names are: Mu Chen, Haoyu, Mu Chen, Mingze, Yichen, Yuze, Haoran, Yize, Yuxuan and Muyang.
The top 1 girls' names are: Ruoxi, Yinuo, Yihan, Yinuo, Zihan, Yimo, Yutong, Xinyi, Yutong and Yuxi.
These names are all beautiful, but in terms of particularity and sensation, they can't compare with the name given to their daughter by Lu couples in Jinan, Shandong Province: Beiyan Yunyi.
On January 25th, 29, the daughters of Lu Xiaofeng and Zhang Ruizheng were born in Jinan, Shandong Province. Because of their passion for poetry and traditional culture in China, the couple decided to name their daughter "Beiyan Yunyi", with Beiyan as their surname and Yunyi as their first name. This name not only sounds good and poetic, but also has a beautiful meaning, and it also has an allusion:
One day, Hongyan passed on a book and placed her love for acacia. Goose has been the object of lovesickness in ancient poems. Jiang Zong, a poet of the Sui Dynasty, wrote in "Returning Yangzhou to Chang 'an Road" that the heart is driven away by the southern clouds, and the shape is followed by the northern geese, and the chrysanthemums in my hometown are under the fence. Today, several flowers bloom. Li Bai, a poet in the Tang Dynasty, wrote in "A Yelang in the South" that Yelang was resentful and left his home, and there was no news in the bright moon building, and the northern geese were eager to see it in the spring, so they could not write a book in the south.
the second saying is: the swallows know the ambition of a swan. Tao Yuanming's "Mourning cicadas without leaving a sound, Cong Yanming flying in the sky" fully embodies the poet's own ethereal and noble spirit.
It can be seen that choosing "Beiyan" as the surname not only entrusts the couple with their love for their daughter, but also implies that her daughter can "jump on the sea and let birds fly in the sky" in the future. "Yunyi" is a better name. Yunyi is actually a kind of inversion, which belongs to the usual method in names. Similarly, Ruby Lin and Zhou Zhiruo, such as Ru and Ruo, all want girls to be like something. The "heart" here should be "Ruxin" and "Zhi Ruo" should be "Ruozhi", and Zhi is a beautiful herb. Therefore, "Yunyi" should have been "Evian", snuggling up to the white clouds, with a sense of security.
In a word, Lv Xiaofeng and Zhang Ruizheng live in the north, using "Beiyan" as their surnames and "Yunyi" as their names. The geese are dependent on the clouds, and the clouds are accompanied by geese. This name is really atmospheric, artistic and good. Personally, I think these names are better than those of the glory of the king and Whampoa Military Academy.
In February, 29, Lv Xiaofeng went to the local police station to apply for registered permanent residence registration for her daughter. She told the police that "Beiyan" was her own surname, and she chose "Beiyan Yunyi" as her name, which was taken from four famous China classical poems, implying her parents' good wishes for her daughter.
The police explained to Lv Xiaofeng that the surname of a newborn should be the father's surname or the mother's surname, that is, the surname "Lu" or "Zhang", otherwise it would not meet the requirements for birth registration. Lv Xiaofeng insisted on applying for household registration for her daughter in the name of "Beiyan Yunyi". Later, the local police station decided to refuse the registration of registered permanent residence in accordance with Article 22 of the Marriage Law.
In order to name her daughter, Lv Xiaofeng took the local police station to court in the name of her daughter "Beiyan Yunyi" and asked the police station to register her name.
Lu Xiaofeng said in the trial that Article 99 of the General Principles of Civil Law stipulates that "citizens have the right to name, the right to decide, use and change their names according to regulations, and it is forbidden for others to interfere, steal or impersonate", while Article 22 of the Marriage Law stipulates that "children can take their father's surname and their mother's surname". Neither law prohibits citizens from naming themselves, but they can take their father's surname or maternal surname.
The local police station put forward three opinions:
1. The General Principles of the Civil Law stipulates that citizens have the right to name, but there is no specific explanation. Article 22 of the Marriage Law is a special provision on children's surnames, which stipulates that children can take their father's surname or their mother's surname, but not their third surname. Acts that are not clearly defined by law cannot be implemented, which means that children have only two choices: taking their father's surname or their mother's surname.
2. The right to name is recognized by law in order to make citizens clearly distinguish themselves from others by their names and realize their own personality and rights. Name right, like other rights, is restricted by law and cannot be abused. It is a traditional custom of the Chinese nation for newborn babies to take their father's surname and mother's surname, which indicates blood relationship, but the third surname is contrary to this traditional custom and the original intention of the surname.
3. Public security organs all over the country have the same standard in implementing Article 22 of the Marriage Law on children's surnames, that is, children should take their father's surname or their mother's surname.
After the case was heard in public for two times, the trial court held that there were differences on the application of Article 99 of the General Principles of Civil Law and Article 22 of the Marriage Law. Regarding the application of law in this case, it is necessary to ask the competent authority to make an explanation or confirmation. As a result, the trial of this case was suspended from March 11, 21 until April 21, 215.
Then, the relevant information of the case was reported at different levels, from the Jinan Intermediate Court in Shandong Province to the Shandong Provincial High Court, to the Supreme People's Court and to the national legislature. In January 214, the national legislature made the Interpretation of Article 99 of the General Principles of the Civil Law and Article 22 of the Marriage Law:
After the relevant interpretation made by the legislature, the People's Court of Lixia District of Jinan City reopened the case on April 21, 215.
The court held that the focus of this case was whether Lv Xiaofeng's proposal to choose the surname "Beiyan" for his daughter was in line with the above-mentioned legislative interpretation "there are other legitimate reasons that do not violate public order and good customs". The court held that this did not belong to this situation, and put forward three opinions:
1. It is beneficial for social management for children to inherit their parents' surnames.
From the perspective of social management and development, it is beneficial for children to inherit their parents' surnames to improve the efficiency of social management, and it is convenient for administrative organs and other social members to make a preliminary judgment on the main social relations of surname users. If surnames are allowed to be chosen at will or even created at will, it will increase the cost of social management, which is not conducive to society and others, to maintaining social order and achieving benign social control, and it will easily lead to confusion and increase the risk and uncertainty of social management.
2. Choosing surnames involves public order and good customs.
in Chinese traditional culture, the surname in "name", that is, surname, mainly comes from objective inheritance and is handed down by ancestors, bearing respect for ancestors and love for family, and embodying blood inheritance, ethical order and cultural tradition.
while "name" originates from subjective creation, is granted by parents, and carries personal preferences, personality characteristics, elders' wishes and so on. Citizens' attention and respect for the inheritance of surnames not only reflects the blood relationship and kinship, but also carries rich cultural traditions, ethical concepts and humanistic feelings, which conforms to mainstream values and is the carrier and mirror image of the centripetal force and cohesion of the Chinese nation.
In principle, citizens adopt their father's surname or mother's surname, which is in line with Chinese traditional culture and ethics, and the wishes and practical practices of the vast majority of citizens. On the other hand, if citizens are allowed to choose surnames or even create their own surnames at will, it will have an impact on cultural traditions and ethical concepts and violate social good customs and general moral requirements.
3. Citizens enjoy the right to name according to law. The exercise of the right to name belongs to civil activities. It should be in accordance with the provisions of the first paragraph of Article 99 of the General Principles of Civil Law and Article 22 of the Marriage Law, and should also abide by the provisions of Article 7 of the General Principles of Civil Law, that is, social morality should be respected and the interests of the public should not be harmed. Under normal circumstances, the behavior of choosing surnames other than the father's surname and the mother's surname mainly exists in the situation that the actual dependency relationship changes, which is beneficial to the physical and mental health of minors and safeguards personal dignity.
in this case, Lu's creation of surnames only based on his personal preference and desire is obviously arbitrary, which does not conform to the legislative interpretation of "there are other legitimate reasons that do not violate public order and good customs" and should not be supported.
In the end, the court ruled that the lawsuit of "Beiyan Yunyi" was rejected, that is, the Lushi couple could not choose "Beiyan" as their daughter's surname.
with the development of economy and society, parents' education level is generally higher and higher, and the names given to their children are becoming more and more cultured. The common names such as tied column and dog residue in the last century have long since disappeared, and they have been replaced by literary names such as Zihan and Yihan, and some unconventional parents have given their children names such as the glory of the king, Whampoa Military Academy and Xie Zulong 'en.
Speaking of which, some people may ask, Can Beiyan Yunyi do it, and why the glory of the king can? Very simple, because the glory of the king's parents have a surname "Wang". In the same way, Beiyan Yunyi can also be used as a name. As long as your surname is "Bei", you can name your child "Beiyan Yunyi". There is indeed a surname of "North".
Now is an era of advocating individuality. As long as it is in line with the law, it is understandable for others to choose a name. However, personally, if they are seriously divorced from tradition, it is not advisable to give their children some strange names just because of their parents' temporary preferences, or to find some uncommon words to show their culture.
The name is the code name of a person's life, and it is the first message we present to others in social communication. Some names may be nothing in the short term, but they may bring great trouble to children's future interpersonal communication. Even some netizens feel inferior and distressed because of their names, and remember why their parents gave them such names, which is worthy of our attention.
to digress, what kind of name is a good one?
I think we should work hard from three aspects: sound, form and meaning. It is catchy to read, neat to look at, and has certain moral or commemorative significance. For example, I like the name Zhou Zhiruo very much. If the two words are both up and down, they are more regular, and the whole is better than the heart. I also like the names Sara and Jiang Yingrong, both of which are artistic, especially Jiang Yingrong, who used the surname and the first name to form a beautiful composition as a whole; There is also the name Ma Huateng, which is more meaningful. Ma Weilong and Ma Tengfei turned into dragons. Is it meaningful?
Last question, do you have any opinions or questions about naming? Welcome to leave a message for discussion.
