Provisions on the management of ship berthing

Legal analysis: with the rapid development of large-scale ships, the contradiction of unreasonable capacity structure of some coastal ports in China is still outstanding, and port administrative departments at all levels should guide port enterprises to speed up the adjustment of wharf structure to meet the requirements of large-scale ship development; For docks that have been incorporated into the wharf structure reinforcement and reconstruction, port enterprises should be urged to complete the reinforcement and reconstruction work as soon as possible. In order to give full play to the role of existing terminals, help port enterprises solve practical production difficulties, standardize the management of berthing capacity, and ensure the safety of ports and ships, the Ministry of Transport has organized research and formulated the Regulations on the Management of Berthing Capacity of Coastal Terminals.

Legal basis: Regulations on the Management of Berthing Capacity of Coastal Terminals

Article 1 In order to standardize the management of berthing capacity of coastal ports, promote the adjustment of port structure and ensure the safety of ports and ships, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production, the Law of People's Republic of China (PRC) Port and other relevant laws and regulations.

Article 2 These Provisions shall apply to the management of berthing capacity of freight ships in coastal terminals, but excluding outfitting terminals.

Article 3 The Ministry of Transport shall be responsible for formulating laws, regulations, standards, norms and systems for the management of berthing capacity of coastal ports and terminals throughout the country, and guiding their implementation.

The provincial port administrative department is responsible for the verification and supervision of the berthing capacity of coastal ports and docks in this area. The port administrative department where the coastal port is located shall be responsible for the supervision of the berthing capacity of local terminals.

Article 4 Coastal docks shall dock cargo ships according to the determined berthing grades. However, in line with the provisions of these regulations, berthing can be reduced or released.
