From naming to renaming, the name registration regulations cover everything.
The problem of having one's own name and someone else's same name seems trivial, and once it comes across, it is very troublesome. What we often see is that there are two people with the same name in school or unit. In order to distinguish them, we can only use "Da Li" and "Xiao Li" to distinguish them.
There are more people with the same name, which often leads to some misunderstandings; Some parents may want to highlight their children's names too much, using some uncommon and difficult words, and some people even make up some words in their names. When renewing the "second-generation ID card", the public security department has repeatedly encountered some people whose names contain uncommon words. Although the ID card certification system has been continuously upgraded, it still cannot cope with all kinds of uncommon words, so it has to use laws and regulations to reduce duplicate names and manage them uniformly.
At present, the Ministry of Public Security has studied and formulated the "Regulations on Name Registration (Draft)", which makes it mandatory for citizens to name their names for the first time: citizens should take their father's surname or mother's surname, but both parents' surnames are allowed. The Marriage Law, which has been implemented before, stipulates that children can take their father's surname or their mother's surname, while the Regulations on the Registration of Names (Draft) stipulates that children can be named after their parents. Allowing children to use their parents' dual surnames can not fundamentally eliminate the problem of citizens' duplicate names, but it can greatly reduce the probability of citizens' duplicate names. At the same time, it is hoped that some unnecessary troubles will be reduced by standardizing the order of naming.
The Regulations on the Registration of Names (Draft) also stipulates that names must not contain simplified traditional Chinese characters; Variant characters that have been eliminated, self-created; Foreign languages; Chinese phonetic alphabet; Arabic numerals; Symbol other words beyond the scope of standardized Chinese characters and minority languages. The "Regulations" also stipulate that the name shall not contain: damaging the dignity of the country or the nation; Violating public order and good customs; Words that are likely to cause adverse public reactions or misunderstandings. The name of the registered population in China is generally more than 2 words and less than 6 words. Of course, those who use national languages or write or translate Chinese characters follow traditional customs.
In addition, citizens who have reached the age of 18 apply for name change registration only once. This regulation is mainly to prevent the abuse of name right and frequent name change. The first draft stipulates that the name change will not be handled: those who have been sentenced to more than fixed-term imprisonment or reeducation through labor for intentional crimes or illegal acts; Being serving a sentence or being subjected to reeducation through labor; Being under investigation in criminal cases or public security cases; Personal credit has a serious bad record.
Reducing duplicate names helps to solve the problem
The "Regulations on Name Registration (Draft)" is the first time to stipulate the names of citizens. The reporter interviewed some Beijing residents, and many people welcomed these provisions in the Regulations, which they thought would reduce the phenomenon of duplicate names and help people's work and life. At the same time, the reporter also found that in fact, the freedom of naming a registered permanent residence is already great, and it is not uncommon to give children a double surname or a four-character name.
Fang Hongying, a staff member in charge of household registration at Heping Street Police Station in Chaoyang District, told the reporter that at present, there are more than 22 million newborns born every year in China, and single-word names have become a mainstream, resulting in an increasing number of people with duplicate names, which has even spread to household registration management, post and telecommunications, savings, social security and other industries. The adoption of both parents' surnames is undoubtedly of positive significance to solving the problem of repeated names of the population with the most surname. According to the current 1,61 surnames in China, this method can add 1.28 million double surnames, which will greatly solve the problem of duplicate names of the population with big surnames.
However, even without the new regulations, the "freedom" of citizens in naming names is already quite large. In recent years, it is not new for children to apply for four-character names, and "double surnames" have already appeared, but generally speaking, they are not many.
Fang Hongying said: "The reason why the Ministry of Public Security drafted and published this regulation is not only to reduce duplicate names in the address book, but more importantly, it will gradually reduce the number of identical names in the long run, which will help the government to carry out various tasks. For example, the reduction of duplicate names can greatly improve the efficiency of household registration staff, reduce the public security problems caused by personnel turnover, and greatly improve the efficiency of public security personnel in eliminating criminal suspects. Therefore, citizens should support the government's work." However, she reminded that when adopting a double surname, parents must take into account their children's future acceptance and don't bother their children because of the novelty of the name.
Wang Tao, a citizen who lives in Tiantongyuan, said, "There are too many duplicate names now, so it's good to use double surnames. Sometimes it is really troublesome to meet someone with the same name as you in life. I used to work with a person with the same name myself, which is a bit awkward. The contact information in the address book will also bring some trouble to colleagues. Although these are not big things, the disadvantages of small things are also inconvenient. I think from the actual situation, adopting the surnames of both parents is conducive to improving the problem of high repetition rate of names. "
are the regulations too restrictive?
However, there are not a few people who have a lot of complaints about the Regulations on Name Registration (Draft), mainly because this first regulation on the naming of citizens interferes too much with citizens' right to name, and emphasizes more on restriction than protection. At the same time, it does not conform to China's traditional name culture and will change China's surname culture to a certain extent.
Some people also expressed their objections to the issue of double surnames. Mr. Zhao, 65, who lives in Dongcheng District, waved his hand again and again: "How can this be? The surnames of our Chinese descendants have been inherited for so many years. Surname represents family, which is the symbol of family and blood relationship. It is against tradition and habit to use parents' dual surnames to have some four-character and five-character names, which is neither fish nor fowl. This is not necessarily a good thing. Moreover, when a child with dual surnames grows up, how can his children name them? If it develops to the second and third generation, isn't it common to have four surnames and six surnames? At that time, I am afraid that the trouble will be much bigger than the current name! "
Zhao Ran, a professor at Peking University Law School, believes that the legislation on names should not be simple and hasty. There are many points in the First Draft that are open to discussion. For example, citizens should change their registered names with their father's surname or mother's surname, and those who have reached the age of 18 should only change their names once, which is an interference to the citizens' right to name. He said: "Any naming, use and change of citizens' names are in line with public interests such as public order and good customs, and should not be restricted, otherwise it will be an excessive intervention in private rights. At the same time, as far as the use of characters is concerned, artificial constraints are unreasonable. For example, traditional Chinese characters are an extremely important part of Chinese traditional culture, and the Chinese community has been arguing about the advantages and disadvantages of simplified Chinese characters and traditional Chinese characters. Regardless of who is right or wrong, we can at least not exclude traditional Chinese characters. More importantly, the evolution of surnames is the product of social, political, economic and cultural changes, and the artificial intervention of surnames in the First Draft will change Chinese surnames culture to some extent. From these aspects, the "First Draft" excessively interfered with the name. "
